January 6, 2014: New Hampshire Administrative License Suspension/DWI Case Example: New Boston police officers were dispatched to a campground for a report of an accident on a golf cart.   Upon their arrival they determined who the operator of the golf cart was.  They questioned this citizen about drinking.  He advised the police that he had consumed a half-gallon of tequila. 

After learning that the citizen drank the unusually large amount of alcohol, the police asked this citizen to perform the series of sidewalk Olympics known as “DWI field sobriety tests”. This citizen, like most others who try them, failed the field sobriety tests and was arrested for DWI.  He declined the officer’s invitation to submit to a breath test because he had drank a half gallon of tequila.

A few days after his release, the driver received the frightening letter from the New Hampshire Department of Safety about the potential consequences of his refusal to take a breath test: the DMV was about to take away his right to drive away for six months for the refusal.  This driver hired Salem DWI defense attorney Mark Stevens to fight his license suspension.  After the officer’s testimony, Attorney Stevens cross examined her and then argued about the absurdity of this arrest for allegedly driving a golf cart while intoxicated.  The hearings examiner took the case under advisement.  A few days later Attorney Stevens received the DMV’s decision to throw this suspension out. This citizen avoided the 180 day suspension for refusing to take a chemical test. 

Note-this is one example of a recent New Hampshire DWI administrative license suspension hearing case result. It is not a guarantee of any particular result in any other case.
